Welcome to Chitown Trendz (“we,” “us,” “our”). By visiting or purchasing from our website (chitowntrendz.com) (“Site”), you engage in our “Service” and agree to be bound by these Terms of Service (“Terms”), including any additional terms referenced herein. If you do not agree to all the Terms, you may not access or use the Site or Services.
1. Eligibility & Acceptance
You represent that you are at least the age of majority in your state of residence or otherwise able to form a binding contract.
You may only use our Services for lawful purposes and must comply with applicable laws and regulations.
We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders at our sole discretion.
2. Orders & Customer Obligations
When placing an order, you must provide accurate and complete information (including artwork uploads, shipping address, billing details).
You are responsible for your uploaded artwork complying with our specifications (e.g., print-ready, transparent background, correct dimensions) and you warrant you hold all necessary rights.
Once an order is submitted, changes or cancellations are only possible if we agree before production begins.
3. Pricing, Payment, Taxes & Duties
Prices listed are in USD (unless otherwise indicated) and may include or exclude applicable taxes; international customers are responsible for customs, duties and import fees.
We reserve the right to change prices and shipping fees at any time before order confirmation.
Payment must be completed at time of order; failure to complete payment may result in cancellation of the order.
4. Production, Shipping & Delivery
Production times and shipping estimates are provided for convenience only and are not guaranteed. Delays may occur for reasons beyond our control (carrier, weather, supply chain, etc.).
Risk of loss and title for items pass to you once we hand over the order to the shipping carrier. We are not liable for lost, stolen or mis-delivered packages once shipped.
You are responsible for providing a correct shipping address. If a package is returned due to an incorrect address, you are responsible for any additional shipping charges.
5. Returns, Cancellations & Reprints
Because we provide custom-printed items (DTF transfers, gang sheets, custom apparel), we do not accept returns or offer refunds or exchanges, except in cases where we determine there is a manufacturing defect or our error.
You may request a cancellation before production begins; once production has begun, cancellations may not be possible.
If you believe there is a manufacturing defect, you must notify us within [48 hours] of delivery, provide your order number, clear photos of the issue and packaging. If approved, we will reprint or repair, at our discretion.
6. Intellectual Property & Artwork Submission
All content on our Site (designs, graphics, text, product photos) is owned by Chitown Trendz or its licensors and is protected by intellectual property laws.
By uploading artwork, you grant us the right to reproduce and print the artwork as necessary to fulfil your order, and you warrant you own or have the rights to use that artwork.
You indemnify us from any liability arising from your submission of copyrighted, trademarked or otherwise protected materials without authorization.
7. Prohibited Uses
You agree not to use the Site or Services to:
Violate any laws or rights of third parties (privacy, publicity, intellectual property).
Upload or transmit malware, viruses or harmful code.
Use the Site to impersonate another person or entity or engage in fraudulent or abusive behavior.
Reverse-engineer, exploit or misuse the Site or any underlying technology or tools.
8. Links to Third-Party Sites & Services
Our Site may contain links or integrations with third-party services (payment processors, shipping carriers, apps). We are not responsible for the policies, practices or content of those third parties. Your use of them is at your own risk.
9. Limitation of Liability
To the fullest extent permitted by law, Chitown Trendz and its affiliates shall not be liable for any indirect, incidental, special, consequential or punitive damages arising out of your use of the Site, the products, or the Services.
Our total liability for any order or claim arising from your use of the Site or our Services shall not exceed the amount paid by you for the product in question.
Some jurisdictions may not allow exclusion of certain warranties or liabilities, so some portions of this section may not apply to you.
10. Indemnification
You agree to defend, indemnify and hold harmless Chitown Trendz, its owners, directors, officers, employees and affiliates from and against any claims, liabilities, damages, losses or expenses (including legal fees) arising out of or in connection with:
Your breach of these Terms;
Your use of the Site or Services;
Your artwork submission or misuse;
Your violation of any rights of another party.
11. Governing Law & Dispute Resolution
These Terms and any dispute arising out of or relating to your use of the Site shall be governed by the laws of the State of Illinois, without regard to its conflicts of law provisions.
You agree to submit to the exclusive jurisdiction of the courts located in Chicago, Illinois for any disputes.
12. Changes to the Terms
We reserve the right, at our sole discretion, to modify, amend, or replace any part of these Terms at any time. The updated Terms will be posted on the Site with a new “Last Updated” date. Your continued access or use of the Site after such changes constitutes your acceptance of the revised Terms.
13. Miscellaneous
Headings are for convenience only and do not affect interpretation.
If any provision of these Terms is held to be invalid or unenforceable, that provision will be deemed severed and the remaining provisions will remain in full effect.
These Terms, together with any other legal notices or policies referenced herein (e.g., Privacy Policy, Shipping Policy) constitute the entire agreement between you and Chitown Trendz regarding the subject matter herein and supersede all prior agreements.
